The Parus Hotel was returned to the ownership of the city
The appeal was won. The Parus Hotel returns to the ownership of the Dnieper. Recently, the court of second instance ruled in favor of the community. We are talking about the termination of the contract for the sale of a well-known unfinished building between the Dnipro City Council and the Rombus Privat company.
Terminate the contract and return the Parus Hotel to the ownership of the community. The court of second instance ruled in favor of the city. The decision of the Central Economic Court of Appeal to terminate the contract between the Dnipro City Council and the private company "Rombus Privat" entered into force on November 18.
“There was a consideration of the first instance in the economic court of the Dnepropetrovsk region. There was a decision in our favor after consideration of the appeal in the court of appeal. The decision remained the same as it was accepted by the court of first instance, ”says Yulia Oleinik, lawyer of the City Council. The Dnipro City Council filed a lawsuit in court in December 2020. The main claim is a violation of the terms of the contract by a private company. According to the document, Rombus Privat had to complete the construction of the Parus hotel complex by August 16, 2020. But in fact, it didn't do that. "The court found that the defendant had no permits, no documentation for putting the facility into operation," Yulia Oleinik said. The Parus Hotel began to be built in Dnepropetrovsk in 1975. In 1995 construction was completely stopped. And since that time, for a quarter of a century, the 28-story building has been abandoned. “At the time when our state became independent, this building got an owner. The owner took upon himself the obligation to put this building in order, to reconstruct it, to improve the territory. But he did not fulfill any of these requirements, and endlessly demanded and demanded an extension of the lease, ”says Mikhail Lysenko, deputy mayor of Dnipro. The mayor's office adds: over the years, the technical condition of the well-known Dnieper long-term construction has deteriorated, and now it has become unsatisfactory. In support of this, there are expert findings. Rombus Privat's ownership of the facility cannot be used to the detriment of residents, lawyers say. We are talking about a cluttered area and accidents that periodically occur on the territory of the Parus Hotel. Therefore, the appellate instance ruled in favor of the community of Dnipro. “This unfinished building has been around for more than a decade. And especially, I walk the dog here and see: like graduations, schoolchildren come, they climb there, and there was even an accident. I really want it to be decided in such a way that it would be both beautiful and without accidents.
- - Do not need any symbols, it's all nonsense. Remove, put a new symbol and make it better. We are moving forward, not backward. Why do we need to look back. It is already outdated, everything in it is outdated. It is no longer suitable. It's easier to destroy and build a new one. Leave the hotel like this or publicly blow it up and build something new, the city hall is still considering. They say that the private company Rombus Privat can file a cassation complaint within 20 days and suspend the previous court decision and start a new trial on the merits.
